This Terms of Business is designed to come into force upon receipt and provides important information regarding the way that we provide our services to you. If you have any questions or require clarification on a particular matter please do not hesitate to contact us.
It is your responsibility to provide complete and accurate information to us and insurers when you affect your policy, throughout the life of your policy, and when you renew your insurance. It is important that you ensure that all statements you make on proposal forms, claim forms and other documents are full and accurate. We cannot be held responsible for incorrect data held in the event of non-disclosure. If you fail to disclose any material information to us or your insurers, this could invalidate your insurance cover and could mean that part or all of a claim may not be paid. To assist us in providing you with a comprehensive service and to keep our records as up-to date as possible, please notify us of any changes to your personal circumstances, e.g. name change, change of address, etc., as soon as possible.

The services which the firm is authorised to provide are:
(a) Advising in relation to the nature of each of the products set out below and recommending you the product/products that are best suited to your needs
(b) Selecting a suitable product or products from product providers in Ireland
(c) Receiving and transmitting orders on your behalf for a product or products to one or more providers
C & E freeman Ltd trading as Easy Life Cover offers a range of products such as life assurance policies, specified serious illness and other protection type policies, pension, savings and investment policies, typically from Irish Life Plc. However in certain circumstances we can offer protection policies and specified serious illness policies from both Royal London Life and Zurich.
So that we can provide you with business services, you will have to give personal information including your name, address, date of birth, and details about your financial arrangements such as your existing protection cover, pension arrangements, and your savings and investments. From time to time you may also need to give sensitive personal information such as medical details. All the personal information you give me will be processed in line with your rights under the Data Protection Acts 1988 to 2003. This information will only be used to provide you with business services, to meet any legal and regulatory obligations, and for legitimate business reasons. For these purposes personal information may have to be given to third parties and to contractors where necessary, to regulatory authorities that need the information by law, to other companies and service providers with whom we have a data processing contract and to any person your plan is transferred to. From time to time, Information about other financial products and services may be sent to you. You have the right to ask us not to send you this marketing material and, at any time you can ‘opt out’ of receiving marketing material. You have a right to see the information that is held on you and you can do this by writing to me at the address above. A charge of up to €6.35 may be required before we send you the information.
You Talk. We Listen trading as TMS Financial Services and The Mortgage Shop may receive commission from the product provider to whom orders are transmitted.
Conflict of Interest
It is the policy of C & E Freeman Ltd trading as easy Life Cover to avoid any conflict of interest when providing business services to its clients. However where an unavoidable conflict may arise we will advise you of this in writing before proceeding to provide any business service. If you have not been advised of any such conflict you are entitled to assume that none arises.
C & E Freeman Ltd trading as Easy Life Cover will, if necessary, exercise its legal rights to receive any payments due to it, from clients for business services provided by it and to be reimbursed for any value obtained by it for clients arising from payments to it by clients which subsequently default. The protection provider(s) may withdraw benefits on default of payments due under any products arranged for your benefit. Details of these provisions will be included in your product terms and conditions.
Any complaint that you may have in relation to the business services provided should be made in writing to C & E Freeman Ltd trading as Easy Life Cover outlining the nature of your complaint. All complaints will be acknowledged in writing within 5 business days of the complaint being received. The complaint will be fully investigated by C & E Freeman Ltd and a full response will be provided to you. C & E freeman Ltd will aim to provide this response not later than 20 business days from receipt of your complaint. In the event that you remain dissatisfied with the firm’s handling of and response to your complaint you are entitled to refer your complaint to the Financial Services Ombudsman’s Bureau or the Pensions Ombudsman (contact details below).

You Talk. We Listen trading as TMS Financial Services and The Mortgage Shopis a member of the Investor Compensation Scheme, which provides certain remedies to eligible clients on default by the firm. Your legal rights against the firm are not affected by this scheme.
Handling Clients’ Money
C & E Freeman Ltd trading as easy Life Cover is not authorised to accept cash or negotiable instruments at any time.
We regret that credit cannot be extended to clients in respect of premiums, initial, renewal or additional. Initial or first premiums must be paid at inception of cover and renewal premiums before the policy renewal date otherwise the Company will advise the insurance undertaking or product producer involved and cover will be cancelled.
We are a member of the investor compensation scheme run by the Investor Compensation Company Limited. The scheme provides a way of paying certain investors compensation, subject to the relevant limits, if they suffer financial loss caused by an investment firm being unable to meet its financial obligations (in other words, pay everything it owes). In the event that a right to compensation is established, the amount payable is the lesser of ninety per cent of your loss, which is recognised as being eligible for compensation, or €20,000.
These Terms of Business are effective from February 2015.
